General Queries
How do I know if I have a valid claim?

You generally have a valid claim if three things are true:

  1. You were injured in the last 3 years.
  2. The accident was someone else's fault (or at least partially).
  3. You sought medical attention for your injuries.

How much compensation will I get?

This depends entirely on the severity of your injury and how it affects your life. Solicitors use the Judicial College Guidelines to value the injury, and then add on any financial losses (lost wages, travel, care costs). You can use our Compensation Calculator for an estimate.

Can I claim on behalf of a child?

Yes. A parent or guardian can act as a "Litigation Friend" for any child under 18. The money is usually held in a court fund until the child turns 18 to protect their future.

Costs & Fees
What does "No Win No Fee" actually mean?

It means exactly that. If your claim is unsuccessful, you do not pay your solicitor a penny. There is no financial risk to you. We take out an insurance policy (After The Event insurance) to cover the other side's costs if you lose.

How much do you take if I win?

If you win, a "Success Fee" is deducted from your compensation. By law, this is capped at 25% of your payout for the injury and past losses. You will always keep at least 75%.

Are there any upfront charges?

No. You will never be asked to pay money upfront to start a claim with us.

The Claims Process
Will I have to go to court?

It is very unlikely. Approximately 95-98% of personal injury claims are settled out of court through negotiation. Court is a last resort if liability is disputed.

How long will my claim take?

It varies. Simple road accidents can settle in 4-6 months. Workplace accidents typically take 9-18 months. Complex medical negligence cases can take 2-3 years. We always aim to settle as quickly as possible without compromising the settlement amount.

Will I lose my job if I claim against work?

No. It is illegal for an employer to fire you or treat you unfairly for making a personal injury claim. Your claim is against their insurance policy, not them personally. See our Work Accident Guide for more details.

Medical Assessments
Do I need to see a doctor?

Yes. To value your claim correctly, we need an independent medical report. We will arrange an appointment with a specialist local to you. It usually takes about 20-30 minutes.

What if I have pre-existing injuries?

You can still claim. The medical expert will determine how much the accident "exacerbated" (worsened) your existing condition or caused new injuries. You will be compensated for the difference.
